DMCA Policy

Zebra Plant respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Zebra Plant will respond expeditiously to claims of copyright infringement committed using the Zebra Plant service and/or website (the "Site") if such claims are reported to Zebra Plant's Designated Copyright Agent identified below.

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to Zebra Plant's Designated Copyright Agent.

Filing a DMCA Notice of Alleged Infringement

When filing a DMCA Notice of Alleged Infringement, please provide the following information:

  1. Identify the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by this Notice, you may provide a representative list of the copyrighted works that you claim have been infringed.
  2. Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material, including at a minimum, if applicable, the URL of the link shown on the Site where such material may be found.
  3. Provide your mailing address, telephone number, and, if available, email address.
  4. Include both of the following statements in the body of the Notice:
    • "I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)."
    • "I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."
  5. Provide your full legal name and your electronic or physical signature.
  6. Deliver this Notice, with all items completed, to Zebra Plant's Designated Copyright Agent:

Zebra Plant will review and address all notices that comply with the requirements above. If we remove or disable access to content in response to a DMCA notice, we may notify the user responsible for the content, providing them with information regarding the notice and options for counter-notification.

Filing a DMCA Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may send a counter-notification to our Designated Copyright Agent. To be effective, a Counter Notification must be a written communication provided to our Designated Copyright Agent that includes substantially the following:

  • Identify the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • Provide your name, address, telephone number, and email address.
  • Include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Zebra Plant may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.
  • Include the following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."
  • Provide your full legal name and your electronic or physical signature.
  • Deliver this Counter-Notification, with all items completed, to Zebra Plant's Designated Copyright Agent:

    Subject: DMCA Counter-Notification

Upon receipt of a valid counter-notification, Zebra Plant will promptly forward a copy to the complaining party who submitted the original DMCA notice. If Zebra Plant does not receive notice from the complaining party within 10 business days that they have filed an action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on Zebra Plant's system, then Zebra Plant may replace the removed material or cease disabling access to it in 10 to 14 business days or more following receipt of the counter-notification, at Zebra Plant's sole discretion.
